It Makes No Sense, I Have No Hands...

So this blog is about the be one year old and I recieved this:
(I don't get it, why would they remove a free sampler?)

Blogger has been notified, according to the terms of the Digital Millennium Copyright Act (DMCA), that certain content in your blog infringes upon the copyrights of others. The URL(s) of the allegedly infringing post(s) may be found at the end of this message.

The notice that we received from the International Federation of the Phonographic Industry (IFPI) and the record companies it represents, with any personally identifying information removed, will be posted online by a service called Chilling Effects at http://www.chillingeffects.org
. We do this in accordance with the Digital Millennium Copyright Act (DMCA). Please note that it may take Chilling Effects up to several weeks to post the notice online at the link provided.

The IFPI is a trade association that represents over 1,400 major and independent record companies in the US and internationally who create, manufacture and distribute sound recordings (the "IFPI Represented Companies").

The DMCA is a United States copyright law that provides guidelines for online service provider liability in case of copyright infringement. We are in the process of removing from our servers the links that allegedly infringe upon the copyrights of others. If we did not do so, we would be subject to a claim of copyright infringement, regardless of its merits. See http://www.educause.edu/Browse/645?PARENT_ID=254 for more information about the DMCA, and see http://www.google.com/dmca.html for the process that Blogger requires in order to make a DMCA complaint.

Blogger can reinstate these posts upon receipt of a counter notification pursuant to sections 512(g)(2) and 3) of the DMCA. For more information about the requirements of a counter notification and a link to a sample counter notification, see http://www.google.com/dmca.html#counter.

Please note that repeated violations to our Terms of Service may result in further remedial action taken against your Blogger account. If you have legal questions about this notification, you should retain your own legal counsel. If you have any other questions about this notification, please let us know.

Sincerely,

The Blogger Team

Off all the things you have up here, Jeebus Rice Aluminium?!? I got that comp free with a magazine so don't quite see the point of ripping it down. The up side is this seems to be the worst that can happen, for now anyway.

Jeebus Rice Aluminium?

Yeah I don't really get it. I can understand if southern lord doesn't like their music up here? but why the free comp? why not the some of the earth or boris stuff?

What do you mean that it seems to be the worst that can happen for now?

I think the worried well is right, also because it's an american law, which can only be applied to americans (and thus blogger) but not to foreign users of blogger!

I'll check out your blog too mona.

The problem is that anybody around the world who uses blogger comes under American law. So it doesn't matter where you are in the or what nationality you are. Google being American you understand. If you repeatedly get DMCA notices they will just take the whole blog down without any consultation. See this.As I put there blogger themselves say 57% of DMCA notices are wrong but they take them down anyway. Your notice are not issued by Southern Lord but by the industry bodies RIAA/IFPI who don't obviously have a fugn clue. Though SOMA is policing the web himself for Monoliths % Dimensions. It went up for two hours at one place about a week ago, and No I missed it too!!!

O'Malley had a huge collection of other artists downloads up for grabs on his Ideologic website a while back. He had it listed as music which needed to be heard or somesuch.

I don't think Southern Lord is your problem. Every once in a while, different music blogs that offer downloads of albums get tagged by anonymous people who hide behind nonsense like DMCA. Believe it or not, there really are people who take it upon themselves to "get" blogs like this one. It's kind of pathetic, and you'd have to be quite a corporate shill to sheriff the web like that, but that's how it is.

The below is from an interview. Here's why I say that SL isn't your problem:

Q: "What kind of a role has the internet played regarding your label? Some people these days operate exclusively via the net, whilst others are still very much mail order based. What’s your stance?"

A: "The internet is a humongous part of Southern Lord. The quick exchange of information and ideas, as well as being able to sell and market your releases is completely invaluable. I don’t think Southern Lord would be operating at the same level it is without the internet."

Q: "Is downloading killing music? Do you harbour any strong feelings sympathetic to or against the RIAA?"

A: "I think at this level, downloading music is not doing any harm. Maybe the majors are feeling a sting… but I think the underground may even be benefiting from downloads and digital sharing of recordings."

Anyway - good blog!

The RIAA interns writing these automated web-crawlers must really be incompetent. It's fitting with how out of touch the industry is though. Several musicians have contacted me with thanks for promoting their music on my blog. The corporate thieves will never recognize us fans as having a place in the music industry though.
